Web Evolution - Terms and Conditions

Please read through our Terms and Conditions, we ask that you do not use our web site service until you have familiarised yourself with them. If you are using or have used our service it is understood that you have agreed to the terms set forth on this page. When we say "We" "Web Evolution", "US" and "our service" we are referring to Web Evolution and its respective products and services. References to "you" "your" "customer" "client" and the like, refer to you, and your agents. These Terms and Conditions can change at any time. It is important that you check back here regularly. Your continued use of this web site implies acceptance of any subsequent revisions.

Website Terms
The following Web site Terms relate to web site packages where the proposal for the project is dated on or after December 31 2009.

Stage One - Initial Payment: Prior to commencing work we must receive a 33% deposit of the quote for your web site, the quote will remain valid for 7 days from the emailed date.

Stage Two: Upon reciept of initial payment we will commence work desiging a look for your web site including any navigation needed and overall look / layout, we will upload the design of your web site to our temporary hosting so you can visit your website as it comes together giving you the opportunity to gather together your images and text information for each page. Once the design / layout / Navigation is acceptable to you we will require the next 33% payment to proceed further. Any changes to the navigation or amount of pages after this stage will incurr further expence.

Stage Three: OK the design, Layout and Navigation is all worked out and now we are going to insert the information you have provided to us to build the completed website. Within 14 business days of receiving design approval for your web site we will supply you with your web site on a temporary domain name in it's completed form for you to view and check for any changes to the content you may have (text & images),

If you haven't supplied your web site content to us by the time of design approval, we will enter your content when it is supplied to us at a later date. The final 34% payment will not, under any circumstances, be delayed for failure by you to supply us with content.

REFUNDS POLICY

Prior To Work Commencing:
You will be eligible for a complete refund of your 33% deposit if no work has commenced on your project from when we receive payment of your deposit, to when we receive notice in writing that you are canceling your project and request a refund.

Once Work Has Commenced:
If you cancel your website after we have commenced working then we will refund your payment minus the costs of any time spent and work already started.

Non payment
If payment for any work on your web site, hosting or domain renewal becomes overdue by more than 7 days we will remove your web site until all outstanding fees are collected.

The Images On Your Web sites
All images supplied by you or created by Web Evolution for your website look and navigation belong to you. All master images or animations used in the process of creating your website are the property of Web Evolution.

Our Intellectual Property
The system that runs your web site remains the property of Web Evolution at all times. The coding, programming and intellectual property that creates your web site is owned by Web Evolution. In purchasing a web site package with us you own the style, design and graphic design of the web site. You also own all of the content that you place onto your web site.

Web site Content
Web sites from Web Evolution can not be used to disseminate, communicate, store or transmit:

• content sexually-explicit in nature;
• racism in any form;
• information that contains virus', worms or malicious elements;
• Content that is deemed inappropriate by Web Evolution, you will be notified and asked to remove the inappropriate content.

Links
As part of your web site build and ongoing hosting Web Evolution has the right to include a back-link from your web site to Web Evolution.

Promotional Material
Web Evolution reserves the right to use client web sites, web designs, layouts, wire frames and collateral in advertising and / or marketing initiatives. This may include portfolio examples on our web site, case studies and other promotional initiatives.

The following attracts our support fee of $55 inc GST in 15 minute increments

• Support from staff over the phone
• Face to face support
• Content changes
• Design changes
• All customer computer hardware issues that we can help with, this is outside of our expertise so is not a guaranteed service
• Time spent investigating a reported issue for which Web Evolution is not responsible
  (ie: Your internet is down, using incorrect passwords multiple times resulting in IP address lock)

Your Privacy
Your privacy is important to us. We dislike SPAM as well. We will never sell, lease or distribute your contact details to any 3rd party. We will only reveal data pertaining to your account if compelled to do so by law.

Use Of Our Email Facility
Do not use your email facility for the purpose of spam. Only send emails to addresses that have requested to receive information from you. We will not be responsible for the emails and any electronic correspondence sent from our system by you. We will fully co-operate with relevant legal authorities requiring information about the efforts of spammers.

Fair Use Policy
We employ a fair use policy to our web sites. If we believe, for any reason, that you are not behaving in a manner expected of a Web Evolution customer then we reserve the right to terminate your hosting effective immediately.

Accessibility
We make efforts to ensure that your web site and all of our services are online 24x7 every day of the year. However, this will not always be the case. There are times when your web site will be down, sometimes for things that we can't control and others that we can. When our service is offline we will do our best to get it online as soon as possible We will not be held responsible for damage, events or losses directly or indirectly related to our web site being offline.

Online
We endeavor to provide at least 99% uptime on all of our hosting. If in a given month, we do not reach this target, we will not offer compensation. We do our best to keep our sites online but can not be held responsible when web sites are offline as there are so many contributing factors.

Liability

We will not be held liable for any action or inaction relating to our service. We offer a quality service at highly competitive rates. We believe that our system is highly secure from the actions of hackers, viruses and other problems on the internet but can make no guarantees. It is up to you to back-up and ensure the integrity of your data offline. If your web site is offline then please contact us and we will try to fix the problem as soon as possible. We will not be liable for loss of sales, leads or reputation from using our service.

Jurisdiction
This web site is governed by the laws of the state of South Australia, Australia. Any dispute arising from the use of this web site will be settled in this jurisdiction.
